Terms of Service

1. Acceptance of Terms

By engaging with Digital Sparky ("we", "us", or "our") or accessing our website, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Digital Services & Engineering

We provide full-spectrum digital engineering, including Next.js web architecture, Search Engine Optimization (SEO), and Social Media Strategy. Specific deliverables, timelines, and costs will be detailed in a separate Service Level Agreement (SLA) or Project Proposal tailored to the client.

3. Client Responsibilities

For us to engineer your digital assets effectively, you agree to provide timely access to necessary resources, including branding assets, text copy (unless otherwise agreed), server access, and prompt feedback during the revision stages.

4. Intellectual Property

Upon final payment, full ownership rights of the custom-developed digital asset (website design, copy, deployed code) transfer to the client. Digital Sparky retains the right to display the completed work in our portfolio, case studies, and marketing materials unless a Non-Disclosure Agreement (NDA) is active.

5. Payments & Billing

Payments are strictly subject to the terms outlined in your specific project proposal. Standard web engineering projects generally require a 50% upfront deposit to secure the development slot, with the remaining 50% due prior to final deployment on the live server.

6. Limitation of Liability

While we use elite, state-of-the-art engineering practices, Digital Sparky shall not be held liable for any indirect, incidental, or consequential damages resulting from server downtime, third-party software failures, or subsequent Google algorithm updates outside of our control.

7. Governing Law

These terms shall be governed and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.
